This Privacy Policy describes how information about you is collected, used and disclosed by LoanVerify Inc., doing business as LoanVerify®  (“LoanVerify®,” “we,” “us” or “our”) when you access or use the websites, mobile applications or other distribution channels now or hereafter provided by us (collectively, the “Sites”) or otherwise interact with us.

LoanVerify® reserves the right to change or modify this Privacy Policy at any time and in our sole discretion. If we make changes to this Privacy Policy, we will provide notice of such changes, such as by sending an email notification, providing push notifications, providing notice through the Sites or updating the “Last Updated” date at the beginning of this Privacy Policy. We encourage you to review this Privacy Policy whenever you use or access the Sites or otherwise interact with us to stay informed about our information practices and the ways you can help protect your privacy.  Our Privacy Notice is available at www.loanverify.com/privacynotice.

Collection of Information:

Information You Provide to Us.

We collect information you provide directly to us. For example, we collect information when you register for a LoanVerify® account, participate in any interactive features of the Sites, subscribe to our Services, communicate with parties to a particular transaction via the Sites, participate in a promotion or event, order or purchase (either for yourself or for another person) services made available through the Sites (collectively, the “Services”), apply for a job, communicate with us via third party social media sites, request customer support or otherwise communicate with us.

The types of information we may collect from you include:

(a)        Account Information, such as your name, email address, password, postal address, phone number, and any other information you choose to provide;

(b)        Transaction Information, such as information about the Services you register for. We may also collect and store limited payment information from you where your activities are subject to payment, such as payment card type and expiration date and the last four digits of your payment card number; however, we do not collect or store full payment card numbers and all transactions are processed by our third party payment processor.

(c)        User Information and Documentation relating to unique loan transactions, such as income and employment verifications, driver’s license and other identification verifications, paystubs, W2 and 1099 forms, tax returns, retirement account statements (including pension and 401K information), social security award letters, disability award letters, bank and other asset statements, mortgage statements, proof of insurance/insurance statements, divorcee decrees, bankruptcy paperwork, letters of explanation, child support agreements, alimony agreements, medical documents to support surgery, and any other document(s) necessary for and/or related to lender loan approval; loan approval documents, contract documents and closing documents (such as appraisals, regulatory disclosures, settlement statements, loan documents and title documents; loan program information and cost estimates; closing checklists and timeline details; and other information related to the relationships and communications between a user and the user’s service providers. Generally loan transaction information is retained throughout the unique loan process and for a period of three (3) years following its receipt by LoanVerify®.

(d)        Information About Others, such as the names and email addresses of other individuals as and when needed to process a transaction or of individuals that you refer to us for participation in the Services.

(e)        Other Information You Choose to Provide, such as when you participate in a promotion or interactive area of the Sites, or when you request technical or customer support.

Information We Collect Automatically

When you access or use the Sites, the types of information we may automatically collect about you include:

(a)        Log Information: When you visit the Sites, our servers automatically record certain log file information, such as your Internet Protocol (“IP”) address, operating system, browser type and language, referring URLs, access times, pages viewed, links clicked and other information about your activities on the Sites.

(b)        Mobile Device Information: We collect information about the mobile device you use to access or use the Sites, including the hardware model, operating system and version, unique device identifiers, mobile network information and information about your use of our mobile applications. With your consent, we may also collect information about the location of your device and access and collect information from certain native applications on your device (such as your device’s camera and phonebook applications) to facilitate your use of certain features of the Sites. (c)        Information Collected by Cookies and Other Tracking Technologies: We and our service providers use various tracking technologies, including cookies and web beacons, to collect information about you when you interact with our Sites, including information about your browsing and purchasing behavior. Cookies are small data files stored on your hard drive or in device memory that help us improve the Sites and your experience, see which areas and features of the Sites are popular, and count visits. Web beacons are electronic images that may be used in the Sites or emails and help deliver cookies, count visits and understand usage and campaign effectiveness. Information We Collect From Other Sources.

We may also obtain information about you from other sources and combine that with information we collect directly. For example, we may collect information about you when you post content to our pages or feeds on third party social media sites, or if you use user credentials (e.g., username and password) from a third party site to create or log into your LoanVerify® account. We may also collect information about you from other participants involved in a unique transaction.

Use of Information:

We may use information about you for various purposes, including to:

(a)        Provide, maintain and improve the Sites and Services;

(b)        Manage your account and send you related information, including confirmations, updates, technical notices, security alerts and support and administrative messages;

(c)        Respond to your comments, questions and requests and provide customer service;

(d)        Communicate with you about the Sites, Services, events and other news and information we think may be of interest to you;

(e)        Monitor and analyze trends, usage and activities in connection with the Sites;

(f)         Detect, investigate and prevent fraudulent transactions and other illegal activities and protect the rights and property of LoanVerify® and others;

(g)        Personalize and improve the Sites and provide advertisements, content and features that match your profile or interests;

(h)        Facilitate contests, sweepstakes and promotions and process and deliver entries and rewards;

(i)         Link or combine with information we get from others to help understand your needs and provide you with a better experience; and

(j)         Carry out any other purpose for which the information was collected.

Sharing of Information:

We may share information about you as follows or as otherwise described in this Privacy Policy.  Please also see our Privacy Notice, available at www.loanverify.com/privacynotice

(a)        With vendors, consultants and other service providers who need access to such information to carry out work or perform Services on our behalf.  I also authorize LoanVerify® to share information that I provide with one or more third party service providers to financial companies to obtain quotes and other information for you concerning services/products that are related to your requests (such as obtaining homeowner’s insurance quotes for you).

(b)        When you participate in the interactive areas of the Sites or interact with us on third party social media sites, certain information that you provide may be displayed publicly, such as your name, photos and other information you choose to provide.  If we permit registration for a LoanVerify® account through one or more third party approved mobile applications/platforms (e.g., Facebook, LinkedIn, etc.), your third party user credentials will permit access to your LoanVerify® account, information, and features;

(d)        In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, rule, regulation or legal process;

(e)        If we believe your actions are inconsistent with our Terms of Use or other policies, or to protect the rights, property or safety of LoanVerify® or others;

(f)         In connection with, or during negotiations of, any merger, acquisition, sale of assets or any business, other change of control transaction or financing; the recipient of your information may subsequently use your information under the terms of their own privacy policies, which may differ from this Privacy Policy;

(g)        Between and among LoanVerify® and any current or future parent, subsidiary and/or affiliated company; and

(h)        With your consent or at your direction, including to other participants in your unique transaction.

We also may share aggregated or de-identified information, which cannot reasonably be used to identify you.

Note that in connection with the Sites and Services, not all users will have access to all documents and other information collected in connection with a unique borrower transaction.

Social Sharing Features:

The Sites may offer social sharing features and other integrated tools, such as the Facebook, Twitter and Pinterest buttons (e.g., “Like,” “Tweet” and “Pin It”), which let you share actions you take on the Sites with other media, and/or, if permitted by us, permit your registration for a LoanVerify® account. Your use of such features enables the sharing of information with your friends or the public, depending on the settings you establish with the entity that provides the social sharing feature. Advertising and Analytics Services Provided by Others:

Interest-Based Ads

We may allow others to serve advertisements on our behalf across the Internet and to provide analytics services. These entities may use cookies, web beacons and other technologies to collect information about your use of the Sites and other websites, including your IP address, web browser, pages viewed, time spent on pages, links clicked and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on the Sites and other websites and better understand your online activity. Customized Ad Campaigns

We may also work with third party social media sites, such as Facebook, to serve ads to you as part of a customized campaign, unless you notify us that you prefer not to have information about you used in this way. Security:

LoanVerify® takes reasonable measures to help protect information about you from loss, theft, misuse and unauthorized access, disclosure, alteration and destruction. Please understand, however, that no security system is impenetrable. Like other companies, LoanVerify® cannot guarantee 100% the security or confidentiality of the information you provide to us. Consequently, while we endeavor to safeguard your personal information against unauthorized access and disclosure, we do not warrant or guarantee the absolute security of any personal information you transmit to, from or through the Sites. In particular, email sent to or from the Sites may not be secure, and you should therefore take special care in deciding what information you send to us via email.  If you share your computer or use a computer that is accessed by the general public, remember to sign off and close your browser window when you have finished your session. This will help to ensure that others cannot access your personally identifiable information.  In the event of a breach of the confidentiality or security of your personally identifiable information, we will notify you as required by law, if reasonably possible and as reasonably necessary so that you can take appropriate protective steps. We may notify you under such circumstances using the e-mail address(es) we have on record for you or through alternative means. You should also take care with how you handle and disclose your personally identifiable information. Please note that once you leave the Sites, whether independently or via links from the Sites, the privacy policies of the site to which you migrate will apply.  This Privacy Policy applies to your interactions with our Sites only.

Your Choices:

Account Information

You may update, correct or modify information about you at any time by logging into your online account, accessing our mobile applications, or by emailing us at support@loanverify.com. If you wish to deactivate your account, please email us at support@loanverify.com, but note we may continue to store information about you as required by law or for legitimate business purposes.

Location Information

With your consent, we may collect information about your actual location when you use our mobile applications. You may stop the collection of this information at any time by changing the settings on your mobile device, but note that some features of our mobile applications may no longer function if you do so.

Native Applications on Mobile Device

Some features of our mobile applications may require access to certain native applications on your mobile device, such as the camera and photo storage applications (e.g., to take and upload photos) and the phonebook application (e.g., to send communications to others involved in your unique transaction). If you decide to use these features, we will ask you for your consent prior to accessing the applications and collecting information. Note that you can revoke your consent at any time by changing the settings on your device.

Cookies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject cookies, but note that doing so does not necessarily affect third party flash cookies used in connection with our Sites.  Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of the Sites. In addition, many web browsers support Do Not Track technology. If you enable Do Not Track, LoanVerify® will not use information about your web viewing activities to tailor your online experience on other sites operated by LoanVerify®. Note, however, that our third party advertising providers may continue to use information about your web viewing activities to tailor advertising to your interests across different sites even when you have Do Not Track enabled in your browser.

Customized Campaigns

You may opt out of receiving our ads as part of a customized campaign conducted on third party social media sites, such as Facebook, by emailing us at support@loanverify.com.

Promotional Communications

You may opt out of receiving promotional communications from us by following the instructions in those communications or by emailing us at support@loanverify.com. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

Push Notifications

With your consent, we may send promotional and non-promotional push notifications or alerts to your mobile device. You can deactivate these messages at any time by changing the notification settings on your mobile device or within our mobile applications.

Children

We do not knowingly collect any personal information from children under the age of 13. We do not provide Services for use by children and all Services we provide are for use by adults only. We request that children under the age of 13 not download the Sites or submit any personal information through the Sites. If we are advised in writing that we have inadvertently received or collected personal information from a child under 13 years of age, we will remove such information from our database.

Your California Privacy Rights

In addition to the other rights described in this Privacy Policy, California law permits residents of California to request certain details about how their information is shared with third parties for direct marketing purposes. Under the law, a business must either provide this information or permit California residents to opt in to, or opt out of, this type of sharing. You have the right to submit a request to LoanVerify® and receive the following information within 30 days of its receipt of that request: (1) the types of personal information disclosed to third parties during the immediately preceding calendar year, (2) the names and addresses of third parties that received the personal information, and (3) if the nature of a third party’s business cannot be reasonably determined from the third party’s name, examples of its Services or services. You are entitled to receive a copy of this information in a standardized format.  Information provided will not be specific to you individually. International Users

Our operations are conducted within the United States. If you access the Sites from outside the United States, your connection may be through and to servers located in your country or the United States. Any personal information you provide may be processed and maintained in the United States on servers and/or other network systems operated by or for LoanVerify® benefit. Regardless of where you live, you consent to have your personal information transferred, processed and stored in the United States, and allow LoanVerify® to use and collect your personal information in accordance with this Privacy Policy.  IF THE JURISDICTION IN WHICH YOU ARE LOCATED OR YOUR COUNTRY OF ORIGIN HAS LAWS OR REGULATIONS WHICH REQUIRE THAT YOUR PERSONAL INFORMATION BE RECEIVED USED, SAVED, TRANSFERRED AND/OR OTHERWISE HANDLED IN A MANNER DIFFERENT THAN AS STATED IN THIS PRIVACY POLICY, THEN YOU ARE NOT AUTHORIZED TO UTILIZE THE SITES.  IF YOU ACCESS THE SITES FROM AND/OR RESIDE OUTSIDE OF THE UNITED STATES, YOUR INFORMATION MAY BE STORED, TRANSMITTED AND SHARED IN ACCORDANCE WITH U.S. DATA PRIVACY LAWS WHICH MAY NOT BE EQUIVALENT TO THOSE IN EFFECT IN YOUR COUNTRY.  YOU EXPRESSLY AGREE THAT YOU WILL NOT USE THE SITES WITH ANY EXPECTATION OF GREATER PRIVACY RIGHTS THAN THOSE TO WHICH YOU HAVE EXPRESSLY AGREED AS STATED IN THIS PRIVACY POLICY.
